These are the terms and conditions for Brufton Hosting, a website hosting service. By requesting an account with Brufton Hosting you acknowledge that you have read, understand, and agree to all our terms and conditions.
The terms "Brufton Hosting", "us", "we" refer to the hosting company. The terms "you", "client", and "users" refer to the people using the Brufton Hosting service.
1. Servers
a) The server space for Brufton Hosting is shared between users, therefore a Brufton Hosting account is a "Virtual Server" account. We will not exceed X accounts per physical computer server.
2. Responsibility
a) Brufton Hosting will not be held responsible for the content of pages hosted on any account provided by us. Users are solely responsible for all the content in their account, and are legally liable for the contents of their account.
3. Content Restrictions
a) You cannot host, or have any links (of any kind) to any of the following:
- Warez
- Pornography
- Copyrighted materials (including music!)
- ROMs
- Emulators
- any thing else illegal
b) If any of the files listed in 3a are found on your account, the files will be deleted. Depending on the severity of the offence, we may also suspend your account pending further inquiries.
c) You may not publish any material that is offensive to other people. This also includes the use of text as well as the names for files, directories, and email addresses.
d) We will be the final judge of what is acceptable or not.
4. Emails
a) If you are found to be taking part in SPAM mailing, your account will be terminated without warning.
b) The use of mailing lists is acceptable, except for when used for SPAM mailing.
c) Virus transfers and the mass transfer of data are also unacceptable.
5. Script Usage
a) Any illegal use of scripts will result in your account being terminated.
b) Use of scripts for intensive server-side tasks (any scripts which require more than 8Mb of server memory and/or more than 30 seconds to execute) is forbidden and will result in your account being terminated.
6. Account Suspensions or Terminations
a) Any account that has been terminated because of a breach of the Terms and Conditions will not receive a refund.
b) Suspended accounts may only receive compensation after a fault of our own. Each case will be considered separately.
c) When account suspensions or terminations are beyond our control, you will be notified of the details as soon as we are aware of the problem.
7. Billing & Contact Information
a) Users are responsible for all charges Brufton Hosting incurs by hosting your account.
b) Your primary (contact) email address is the email address where any notifications or alerts will be sent. It is your responsibility to check this email account regularly and ensure you notify us if you change this email address.
c) Any changes to these Terms and Conditions will be sent to your primary email address.
d) If we change your account details, we will inform you via your primary email address. Please note that downgrades on your account will only be made at your request.
8. Use of Data
a) We will store your details submitted upon registration until such a time as you decide to leave Brufton Hosting.
